Terms

The agreement

These terms apply between Hostnali Webhost Limited and the organisation subscribing to Call Centre. Using the service means accepting them.

What we provide

Access to the Call Centre system for the number of agent seats you have subscribed for, together with the phone numbers and call capacity set out in your order.

Fees and billing

Seats are billed monthly in advance in Kenya Shillings. Call time, messages and numbers are billed as used. Invoices are due on issue unless agreed otherwise. VAT is charged where it applies and shown separately.

Non-payment

If an invoice goes unpaid we will contact you before anything is suspended, and a grace period applies. Service is only suspended after that period has run, and your data is retained during it.

Your responsibilities

You are responsible for what your team does with the system, for telling callers about recording where you use it, for having a lawful basis for calls and messages you send, and for keeping to Kenyan law and the rules of the networks that carry your traffic.

Acceptable use

The system may not be used for unsolicited bulk calling or messaging, fraud, harassment, or anything unlawful. We may suspend an account causing harm to others or breaching a network's rules, and will tell you why.

Availability

We aim to keep the service available at all times and will give notice of planned maintenance. Calls travel over networks we do not control, and we cannot be responsible for faults that originate with a carrier or with your own internet connection.

Your data

Your contacts, call history and recordings remain yours. You can ask for an export at any time, including when closing the account. See the privacy notice for how we handle it.

Ending it

Either side may end the agreement with 30 days' notice. There is no minimum term beyond the month you are in. On termination we will provide an export on request and then delete your data in line with our retention practice.

Liability

Our liability in any twelve month period is limited to the fees you paid in that period. Neither side is liable for indirect or consequential loss. Nothing here limits liability that cannot be limited in law.

Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.
